LEGAL & COMPLIANCE

Business Associate Agreement.

Protecting Health Information. Defining Our Responsibilities.

HealthVision recognizes the importance of protecting patient health information and establishing clear responsibilities between healthcare organizations and their technology providers.

A Business Associate Agreement (BAA) helps define the permitted handling of protected health information, the safeguards required, and the obligations of each party under applicable HIPAA requirements.

Where required, an appropriate BAA must be executed between the relevant parties before HealthVision processes PHI on behalf of a covered entity.

The Business Associate may use or disclose PHI only as permitted or required by the executed Agreement, the underlying service agreement, or applicable law.

The Covered Entity remains responsible for its own legal obligations, including applicable patient notices, workforce policies, and authorized access decisions.

The Covered Entity must have the right to terminate the Agreement for a material violation by the Business Associate, subject to the applicable legal and contractual provisions.

Upon termination, the Business Associate shall return or destroy PHI as required by the Agreement, where feasible.

If return or destruction is infeasible, the executed Agreement must address continued safeguards and restrictions on any retained PHI.

Applicable obligations concerning retained PHI shall survive termination for as long as required.
